Terms of Service

WeCar (“the Platform”, “we”), published by Roméo Ivaldy, is a carpooling matching platform for private individuals in Cambodia. By creating an account or using the service, you accept these terms. If you do not accept them, do not use the service.

WeCar merely connects drivers and passengers. WeCar is not a carrier, not a transport organizer, and not a party to the carpooling arrangement, which is entered into directly between the driver and the passenger(s).

WeCar makes no guarantee regarding the occurrence, quality, safety, or legality of journeys, nor regarding the conduct, identity, or reliability of users.

WeCar is strictly limited to cost-sharing carpooling. The amount requested by a driver is a contribution to the actual costs of the journey (fuel, tolls, wear) and must not generate any profit. Any use for paid transport, taxi, or commercial service is prohibited and may result in account suspension.

You must be at least 18 years old and provide accurate, up-to-date information. To offer a ride, you must hold a valid driving licence, valid insurance covering the carriage of your passengers, and a roadworthy vehicle compliant with applicable regulations.

WeCar does not collect, hold, or transfer any funds. Cost-sharing is settled directly between users, notably in cash. WeCar is not a payment institution, does not act as an escrow agent, and is not a party to payments.

WeCar is not responsible for non-payment, overpayment, no-shows, refunds, or any financial dispute between users, which must be resolved directly between them.

The driver warrants: a valid licence, insurance covering passengers, a compliant and maintained vehicle, compliance with traffic laws and applicable regulations, and the accuracy of published information (vehicle, plate, route, seats, price).

The passenger undertakes to pay the agreed contribution, to respect the driver, other passengers, and the vehicle, and to behave safely and lawfully during the journey.

The following are prohibited: carrying illegal or dangerous goods, any discrimination, harassment, fraud, identity theft, fake reviews, automated data collection, and any illegal activity or activity infringing the rights of others or of the Platform.

WeCar verifies users' phone numbers but does not, unless stated otherwise, verify real identity, driving licence, insurance, or vehicle condition. You are solely responsible for your safety: we recommend checking the other party's information, reading reviews, and choosing safe meeting points.

You are responsible for the content you publish (listings, reviews, messages, photos) and warrant that it is lawful. WeCar may, without being obliged to, moderate, suspend, or remove any content reported as unlawful or contrary to these terms, and suspend the relevant accounts.

The service is provided “as is” and “as available”, without warranty of being error-free or uninterrupted. WeCar may change, suspend, or discontinue all or part of the service at any time. WeCar is currently in its launch phase.

To the maximum extent permitted by applicable law, WeCar is not liable for damages arising from a journey, an accident, a user's conduct, a payment dispute, content published by a user, or service unavailability. WeCar cannot be held liable for relationships between users.

Nothing in these terms excludes or limits WeCar's liability where applicable law prohibits it, nor deprives a consumer of the mandatory protections available in their country of residence.

You agree to indemnify WeCar against any claim, loss, or damage arising from your use of the service, your breach of these terms, or your infringement of a third party's rights.

WeCar may suspend or close an account in the event of a breach of these terms or abusive use, without notice where safety or legality requires it.

WeCar may amend these terms. The version in force is the one published on the site. Continued use after a change constitutes acceptance.

These terms are governed by French law. Any dispute falls under the jurisdiction of the French courts, subject to the mandatory consumer-protection provisions applicable in the user's country of residence (notably Cambodian law). In the event of any discrepancy between language versions, the French version prevails.
